COACHING AGREEMENT 

DATES: This coaching agreement commences on the date you purchased this coaching package at homeceoacademy.com and concludes on June 30, 2025.  It includes the following:

  • 6 bi-weekly group coaching calls (10am ET)
  • Health and wellness onboarding assessments
  • Access to the Healthy Living Resource Library.
  • Weekly inspiration to your inbox
  • Access to a community where you can connect with your coach and others on a health and wellness journey.

SERVICES: Coaching is a relationship of respect between coach and client. The approach will be to utilize client strengths and values with coach strategies to move toward greater health and wellness.

ROLES: The Client understands that the role of a Life and Health Coach is not to prescribe, provide medical care, to diagnose, to treat or to cure any disease/condition of the physical or mental condition of the human body. Rather, the Coach is a mentor who has been trained to motivate and empower clients to reach their health goals via positive, sustainable lifestyle changes. The Client understands that the Coach is not acting in the capacity of a doctor or psychologist, and that any advice given by the Coach is not meant to take the place or advice by these professionals. The Client should discuss any dietary changes or potential dietary supplements use with his or her doctor, and should not discontinue any prescription medications without first consulting his or her doctor. The Client has chosen to work with the Coach and understands that the information received should not be seen as medical advice and is not meant to take the place of seeing other licensed health professionals. 

PERSONAL RESPONSIBILITY AND INDEMNITY: The “Agreement” refers to Health Coaching Services between the Coach and Client. The Client acknowledges to take full responsibility for the life and well-being of the Client (and family/children where applicable), including all related decisions made during and after this Agreement. The Client expressly assumes the risks of the Agreement, including the risks inherent of trying new foods, or lifestyle changes.The Client releases the Coach from/against any and all liability, damages, causes of action, allegations, suits, sums of money, expenses, claims and demands whatsoever, in law or equity, which the Client ever had, now has or will have in the future against the Coach arising from (i) the Client’s past or future participation in the Agreement; (ii) the acts or omissions of Coach in connection with the Agreement; or (iii) any accident, injury or death to persons, or loss of or damage to property, or fines and penalties which may result in whole or in part, by reason of the Agreement except to the extent that such damage is due solely and directly to the gross negligence of the Coach.

CONFIDENTIALITY: The Coach will keep the Client’s information private, and will not share the Client’s information unless the Client has provided written permission to share, or unless someone’s life is at risk, or unless compelled to by law.  Client understands that any posts they voluntarily share in the community forums are available to view by other members of the forum. 

ARBITRATION, CHOICE OF LAW, AND LIMITED REMEDIES: In the event that there ever arises a dispute between Coach and Client with respect to the services provided pursuant to this agreement or otherwise pertaining to the relationship between the parties, the parties agree to submit to binding arbitration before the American Arbitration Association (Commercial Arbitration and Mediation Center for the Americas Mediation and Arbitration Rules). Any judgment on the award rendered by the arbitrator(s) may be entered in any court having jurisdiction thereof. Such arbitration shall be conducted by a single arbitrator. The sole remedy that can be awarded to the Client in the event that an award is granted in arbitration is refund of any Health Coaching Services Fees. Without limiting the generality of the foregoing, no award of consequential or other damages, unless specifically set forth herein, may be granted to the Client. This agreement shall be construed according to the laws of the State of Georgia. In the event that any provision of this Agreement is deemed unenforceable, the remaining portions of the Agreement shall be severed and remain in full force.

If the terms of this Agreement are acceptable, please check this box to accept terms and conditions. By doing so, the Client acknowledges that: (1) he/she has received a copy of this agreement; (2) he/she has had an opportunity to discuss the contents with the Coach and, if desired, to have it reviewed by an attorney; and (3) the Client understands, accepts and agrees to abide by the terms hereof.

AFFILIATIONS:  Home CEO, Inc. offers training and coaching on the Full Focus life planning and time management tools, by request, and earns a small commission on products from the Full Focus store.

PRIVACY POLICY

This privacy policy covers any information we collect, use and share from you.This privacy policy applies to the websites: homeceoacademy.com. This privacy policy does not cover how our Users may use or share data that they collect using our services.

How We Use Your Information:

  • We do NOT sell your information.
  • We have a legitimate interest in running a successful and efficient business and in providing you with Services and useful content, and we use the information we collect, both on its own and combined with any other information we collect about you, for the following purposes:
    • To provide the requested Services to you;
    • To provide you with useful content;
    • To offer and improve our Services;
    • To provide you with requested information or technical support
    • To improve advertising and marketing our Services (with your consent when required by law);
    • To advertise and market 3 rd party products/services (with your permission where required by law)
    • To administer our websites
    • To communicate with you;
    • To target prospective customers with products /services (with your permission where required by law);
    • To offer you a personalized experience or otherwise tailor our Services to you
    • To process payments: Payment information that you provide to us including credit card data, will only be used to facilitate payment for our products and services. We do NOT retain payment information from anyone. We utilize a secure 3rd party for processing payments, and protect its transmission through the use of encryption such as the Transport Layer Security (TSL) protocol. Not all 3rd party payment systems are HIPAA compliant.

Your Rights

  • You can ask to get copies of your records, and we’ll provide summary copies within 30 days of your request – charging a reasonable fee.
  • You can ask us to contact you in a specific way (home, office) or different address.
  • You can ask us NOT to share your health information in our records.
  • You can choose to share your records with others (family, medical power of attorney or other), and notify us in writing/email.

Sharing of Information

As further described below, we will only share certain personal information with:

  • Network health coach referrals by request (with your permission where required by law)
  • Third party service providers and vendors as needed (ensuring a HIPAA-compliance contract where possible) for legal reasons
  • If data is transferred as part of a sale, merger, acquisition transaction, your notification will highlight any choices you have regarding the data.
  • If legally required to do so, or if we have a good faith belief that such disclosure is reasonably necessary, we may disclose your personal information to courts of law, law enforcement authorities and other relevant third parties, such as internet service providers, to conduct an investigation, respond to a third party or law enforcement subpoena or court order, bring legal action, prevent harm to others or pursue other relief when you or a third party are or may be:
    • Violating our terms and conditions of use
    • Causing harm/violation to us or others
    • Violating federal, state, local, or other applicable law.

Security

The transmission of information via the internet, email or text message is not completely secure. Although we will do our best to protect your personal information, we cannot guarantee the security of your information transmitted through the Services or over all email carriers; any transmission is at your own risk.

Once we have received your information, we will take appropriate technical and organizational measures to safeguard your personal information against loss, theft and unauthorized use, access or modification.

Retention of Personal Information

We retain your personal information to provide services to you and as otherwise necessary to comply with our legal obligations, resolve disputes, and enforce our agreements. We will retain your personal information for no more than six years following the later of (i) the date on which you terminate your use of the Services unless we are otherwise required by law or regulation to retain your personal information for longer.

In the event that you wish to make a complaint about how we process your personal information, please contact our Data Protection Officer at [email protected] and we will respond to your request.

Notification of Changes

We reserve the right to modify this privacy policy at any time, so please review it frequently. If we decide to change this privacy policy in any material way, we will notify you via email or website notice. In all cases, your continued use of any Services constitutes acceptance to any such changes.
